The e-Disclosure Information Project

The
e-Disclosure
Information Project collects and disseminates information about
electronic disclosure / electronic discovery in the context of court rules and procedures,
of regulatory requirements and for internal investigations. Although
originally aimed only at the UK, it quickly embraced the US and other
common law countries where disclosure / discovery of documents is
required.
The Project is sponsored by the companies whose logos appear here. As
well as the financial support, their sponsorship provides a pool of
expertise and examples to draw on to illustrate what is involved in
electronic disclosure.

The main outputs
from the Project are my
blog, this web site and numerous public and in-house talks and
seminars. Electronic
disclosure stands at the
cross-roads of two technical subjects - the rules and the technology
solutions. It is also fundamental to the business practices of litigation
lawyers. I write and speak
about it in the UK and internationally, often in tandem with
Senior Master Whitaker
and
HHJ Simon Brown QC of the Birmingham Civil Justice Centre.
I am a member of Senior Master Whitaker's Working Party, responsible for
drafting the UK's new Edisclosure Practice Direction and Electronic
Documents Questionnaire.
The initiative embraces everything from policy to practice development to
the details of data exchange. It retains its roots in England & Wales whilst
growing in influence in other common law jurisdictions whose rules require the
exchange of documents.

Jurisdictions
Discovery of documents (renamed "disclosure" in England & Wales
since 1999 for no good reason) is a feature of most common law
jurisdictions. There is active interest in improving the process in:

Regulatory activity and the demands of US courts and authorities require EU
companies to apply discovery principles and practices.
